Gather (“Gather,” “we,” “us,” or “our”) provides a social poker entertainment platform that allows players to participate in games using personal devices while shared game information is displayed on televisions or other shared screens at participating venues.

This Privacy Policy explains how information may be collected, used, stored, and disclosed when you use Gather, including the Gather website, player experience, venue displays, applications, and related services (collectively, the “Services”).

When you create or use a Gather account, we may collect information you provide, such as:

• Profile image, if provided

Gather may also maintain information associated with your participation in games, including player statistics, game history, chip balances, achievements, rankings, or similar information.

When you participate in a Gather game, we may collect information necessary to operate and maintain the game, including:

• Hands and game results
• Chip activity
• Player statistics
• Venue participation
• Tournament, league, or season participation

Private cards and other game information may be delivered to your personal device as part of normal gameplay.

When you access Gather, we may automatically receive limited technical information, which may include:

• Device identifiers where applicable

• Diagnostic information

3. Shared Screens and Other Players

Gather is designed as a social, multiplayer experience.

Certain information may therefore be visible to other players or on shared venue displays. This may include your display name, profile image or avatar, seat assignment, chip count, game actions, statistics, rankings, achievements, and other information intended to be public within the game.

Private information, such as a player's hole cards, is intended to be displayed only to the appropriate player during active gameplay unless disclosure is required by the rules of the game.

Your display name, profile image, and public game results are visible to other Gather users in player profiles and leaderboards. These public competition results cannot be hidden using a profile setting. Choose a display name and profile image you are comfortable sharing.

4. Participating Venues

Gather may be available at independently owned and operated bars, restaurants, entertainment establishments, or other participating locations.

A participating venue does not automatically receive access to your private Gather account information simply because you play Gather at that location.

Gather may provide venues with aggregated or operational information necessary to host and understand Gather activity, such as the number of participants, games played, table activity, or similar venue-level information.

If a venue independently collects information from you outside of Gather, that information is governed by the venue's own privacy practices.

5. How We Share Information

We do not sell your personal information.

We may disclose information when reasonably necessary to:

• Service providers that help us operate, secure, host, maintain, or support Gather
• Authentication or infrastructure providers used to deliver the Services
• Comply with applicable law, regulation, legal process, or valid governmental request
• Investigate fraud, cheating, security incidents, abuse, or violations of our policies
• Protect the rights, property, safety, or security of Gather, our users, participating venues, or others
• Complete a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction

Service providers are permitted to process information only as appropriate to perform services for us and subject to applicable contractual and legal requirements.

6. Advertising and Sponsorships

Gather may display venue information, promotions, sponsorships, or advertising within the Services.

If Gather introduces personalized advertising or additional advertising-related data practices in the future, this Privacy Policy will be updated as appropriate.

7. Poker, Chips, and Gameplay

Unless expressly stated otherwise for a particular authorized feature, Gather is intended to provide social entertainment using virtual or play chips.

Virtual chips, points, rankings, achievements, or similar gameplay items do not represent cash, stored monetary value, or an entitlement to payment from Gather.

Gather should not be used for unlawful gambling or wagering.

8. Data Retention

We retain information for as long as reasonably necessary to provide the Services, maintain legitimate business records, protect the integrity and security of Gather, resolve disputes, enforce agreements, and satisfy legal obligations.

Retention periods may vary depending on the type of information and why it was collected.

9. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, alteration, disclosure, or destruction.

No internet-connected system can be guaranteed to be completely secure, and we cannot guarantee absolute security of information transmitted to or stored by Gather.

10. Your Choices and Rights

Depending on where you live, applicable law may provide rights concerning your personal information.

These may include the right to request access to, correction of, or deletion of certain personal information.

You may also be able to modify certain account or profile information directly through Gather.

11. Account Deletion

Users may request deletion of their Gather account and associated personal information by contacting us using the information below.

Some information may be retained when reasonably necessary for security, fraud prevention, legal compliance, dispute resolution, or other legitimate purposes permitted by law.

Game records may also be retained in anonymized or aggregated form where they no longer identify the player.

12. Children's Privacy

Gather is not intended for children under 13, and we do not knowingly collect personal information from children under 13.

Participating venues may impose higher minimum-age requirements based on venue policies or applicable law.

If we learn that personal information from a child under 13 has been collected in violation of applicable requirements, we will take reasonable steps to delete it.

13. Third-Party Services

Gather may use or integrate with third-party services for functions such as hosting, authentication, analytics, communications, or application distribution.

Those providers may process information according to their agreements with us and, where applicable, their own privacy policies.

Gather may also contain links to third-party websites or services. We are not responsible for the privacy practices of independently operated third parties.

We may update this Privacy Policy as Gather evolves.

When we make changes, we will update the “Last Updated” date at the top of this policy. Material changes may also be communicated through the Services or by other reasonable means when appropriate.

Your continued use of Gather after an updated policy becomes effective is subject to the updated policy and applicable law.
